I find reports on internet law, a bit amusing. As usually it's the US wanting to "ban" things, but it seems that the politicans seem to keep forgetting that the internet is Global. And although laws might exists in the USA and elsewhere which would make things illegal. It wont stop it from being spread from countrys with do not have agreements with the USA and others. Such as the situation with the tk domain names. Which fall outside the jurisdiction of the USA. So alot of companys, such as Kazaa and others will register there to be outside of the long-arm of the law. And I am sure those who do spamming with end up originating in countrys such as this.
If you dont want to stop hijackers, adware, spyware and viruses from being effective, stop using Microsoft Windows, switch to an alternative OS.
