It is far bigger fish to fry, catching someone who is uploading music, such as many of the release groups which have gone from running warez sites to uploading music.
But downloading music that is copyrighted and not permitted to be shared is still illegal.
Also, we are talking about copyrighted works which prohibit redistribution. If a band decides to release their own content online for their fans to sample the music, they are giving access to their music, you could upload it or download it. It would be legal both ways.
If any average person makes a song and releases it to the general public, and gives the rights for others to distribute it, it is not illegal music.
